These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Batelco quick pay Financial Services S.A. ("Batelco quick pay," "we," "us," or "our"), a financial institution licensed and regulated by the Central Bank of Argentina under license number BCRA-2024-0157.
By creating a Batelco quick pay account, accessing our digital banking platform at www.baetlco.com, utilizing our mobile applications, or engaging with any Batelco quick pay services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable regulations governing financial services in Argentina and international banking law.
If you do not agree with any provision of these Terms, you must immediately discontinue use of all Batelco quick pay services and contact customer support to close your account.
To establish and maintain a Batelco quick pay account, you must meet the following eligibility criteria:
Batelco quick pay reserves the right to request additional documentation or information at any time to verify continued eligibility. Failure to provide requested information may result in account restrictions or closure.
When registering for a Batelco quick pay account, you must provide accurate, complete, and current information. You agree to promptly update your account information if any changes occur. Providing false or misleading information constitutes a material breach of these Terms and may result in immediate account termination and potential legal action.
You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and multi-factor authentication devices. You must not share your credentials with any third party under any circumstances. Batelco quick pay employees will never request your password or authentication codes.
You must immediately notify Batelco quick pay at +54 11 4567-8911 or security@baetlco.com if you suspect any unauthorized access to your account or any security breach. You may be held liable for losses incurred prior to notification if you fail to promptly report suspected unauthorized activity.
Batelco quick pay requires multi-factor authentication (2FA) for all accounts. You are responsible for maintaining access to your authentication methods. If you lose access to your 2FA device, you must follow the account recovery procedures and may be required to provide additional identity verification.
Batelco quick pay provides various digital banking services including checking and savings accounts, payment processing, fund transfers, bill payment services, investment products, and business banking solutions. Specific services available to your account depend on your account type, residency, and regulatory requirements.
By initiating any transaction through Batelco quick pay services, you authorize us to execute that transaction according to your instructions. You acknowledge that certain transactions, particularly wire transfers and international payments, may be irreversible once processed. You agree to verify all transaction details carefully before confirmation.
Batelco quick pay imposes daily and monthly transaction limits based on account type, verification level, and regulatory requirements. These limits may be modified at Batelco quick pay's discretion for security or compliance reasons. Current limits are displayed in your account settings and may vary based on transaction type.
Transaction processing times vary based on transaction type, destination, and banking network availability. Domestic ACH transfers typically complete within 1-3 business days. International wire transfers may require 3-5 business days. Batelco quick pay is not responsible for delays caused by intermediary banks, correspondent banking relationships, or circumstances beyond our reasonable control.
Batelco quick pay maintains a comprehensive fee schedule available at www.baetlco.com/fees detailing all applicable charges for services, transactions, and account maintenance. Fees are subject to change with 30 days' prior notice to customers. Continued use of services after fee changes indicates acceptance of the modified fee structure.
Certain account types may incur monthly maintenance fees if minimum balance requirements are not maintained. Monthly maintenance fees, if applicable, are automatically deducted from your account on the first business day of each month. Insufficient funds to cover maintenance fees may result in account closure.
Specific transactions including wire transfers, currency conversions, and certain ATM withdrawals may incur fees as specified in the fee schedule. International transactions may be subject to additional correspondent bank fees beyond Batelco quick pay's control. You authorize Batelco quick pay to deduct all applicable fees from your account balance.
You agree to use Batelco quick pay services only for lawful purposes and in accordance with these Terms. You must not use Batelco quick pay services to engage in, facilitate, or support any illegal activities including but not limited to money laundering, terrorist financing, fraud, tax evasion, or sanctions violations.
The following activities are strictly prohibited and may result in immediate account suspension or termination:
Batelco quick pay employs automated systems and manual review processes to monitor account activity for suspicious transactions, unusual patterns, or potential violations of these Terms. We reserve the right to investigate any suspicious activity and to cooperate with law enforcement agencies as required by law.
Batelco quick pay reserves the right to suspend, restrict, or terminate your account at any time without prior notice if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, posed a security risk, or if required by law or regulatory directive. During suspension, you may not access your account or conduct transactions, but you retain ownership of funds subject to regulatory holds.
You may close your Batelco quick pay account at any time by contacting customer support. Account closure requires settlement of all outstanding obligations, pending transactions, and any applicable fees. Upon closure, your remaining balance will be transferred to an external account of your designation after verification.
Provisions of these Terms that by their nature should survive termination shall continue to apply, including sections related to disputes, intellectual property, limitations of liability, and indemnification.
All content, features, functionality, software, trademarks, service marks, and trade dress of the Batelco quick pay platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, are the exclusive property of Batelco quick pay or its licensors and are protected by Argentine and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Batelco quick pay services solely for your personal or internal business purposes. This license does not permit any resale, commercial use, collection, or derivative use of Batelco quick pay services or content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, batelcoquickpay SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL batelcoquickpay'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO batelcoquickpay SERVICES EXCEED THE AMOUNT OF FEES PAID BY YOU TO batelcoquickpay DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Batelco quick pay, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of Batelco quick pay services, your violation of these Terms, or your violation of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of Argentina, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be settled by binding arbitration administered by the Buenos Aires Commercial Arbitration Center in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Spanish in Buenos Aires, Argentina. Judgment on the arbitration award may be entered in any court having jurisdiction.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Batelco quick pay individually. You waive any right to participate in any class action, collective action, or representative proceeding against Batelco quick pay.
Batelco quick pay reserves the right to modify these Terms at any time. Material changes will be communicated to customers via email and prominent notice on the Batelco quick pay platform at least 30 days before the effective date of changes. Your continued use of Batelco quick pay services after the effective date constitutes acceptance of the modified Terms. If you do not agree with the modifications, you must discontinue use of Batelco quick pay services and close your account.
